29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary: a) 7 Burnett Street, Maplewood, NJ. Subcontractor employees were exposed to struck-by injuries in the 6 foot to 14 foot deep excavation as the soil and rocks which could fall into the excavation were not kept back at least 2 feet from its edges. Violation observed on or about 03/18/2013.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(2) in that the excavation was benched at an angle steeper than one horizontal to one vertical (45 degrees measured from the horizontal) and bench dimensions did not follow Appendix B Figure B-1.2 for "Excavations Made in Type B Soil." a) 7 Burnett Street, Maplewood, NJ. Subcontractor employees were exposed to struck-by and crushing injuries in the 6 to 14 foot deep excavation which was not adequately benched or protected by shields or shoring. Violation observed on or about 03/18/2013.
