29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.  Location: 6 Platt Street New York, NY./3rd floor, Mechanical Room  On or About 03/15/2013  a)  Employees were using a 13 feet high tubular welded frame scaffold that had no means of access. Employees climbed crossbraces and frames to get to work platform.

29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level.   Location: 6 Platt Street New York, NY./3rd floor, Mechanical Room    On or About 03/15/2013   a)  While working on a 13 feet high tubular welded walk through frame scaffold employees were utilizing a full body harness and a 6 feet long lanyard that was connected to a 12 feet long strap attached to the scaffold frame, generating a total free fall distance of 18 feet.

Employees were utilizing an improper personal fall arrest system while exposed to a potential fall of approximately 13 feet to the ground below. And did not recognize how to safely use the fall arrest system.
