29 CFR 1926.20(b)(4): The employer did not permit only those employees qualified by training or experience to operate equipment and machinery: (a) 197 Temple St West Boylston, MA: On or about March 11, 2013, a man was struck and run over by a Cat 305 C mini excavator operated by an employee who was not qualified or trained to operate such machinery which is not in accordance with this subpart: Specific abatement documentation that this violation has been corrected must be provided within 10 days of the abatement in accordance with 29 CFR 1903.19(d)(1).

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury: (a) 197 Temple St W. Boylston, MA: On or about March 11, 2013 the employer provided no training of any kind to his employee prior to this date when he caused serious injury to another worker by backing over him with a mini excavator which is not in accordance with this subpart: Specific abatement documentation that this violation has been corrected must be provided within 10 days of the abatement in accordance with 29 CFR 1903.19(d)(1).
