OSH ACT of 1970 Section (5)(a)(1): Respondent Burnham Industrial Contractors, Inc., did not furnish employment and a place of employment which were free from recognized hazards that caused or were likely to cause death or serious physical harm: a. Jobsite: Harrison Power Station, RR 20, Haywood, WV 26366 - Respondent Burnham Industrial Contractors, Inc., exposed employees to the recognized hazard of stepping onto and falling partially or completely through the thin inner lagging of an operational process ventilation duct thereby exposing them to potential lacerations, thermal burns, and asphyxiation from the dangerous environment inside the duct.

29 CFR 1926.501(b)(8)(i): Each employee less than 6 feet (1.8 m) above dangerous equipment was not protected from falling into or onto the dangerous equipment by guardrail systems or by equipment guards: (a) First Energy Harrison Power Station, Haywood, WV: A guardrail system or appropriate guarding was not used to protect Insulators and Sheetmetal workers from accidentally falling onto and through the top surface of the operational 2A Precipitator Inlet Duct. Employees were exposed to hazards including severe metal lacerations, thermal burns, and an oxygen deficient atmosphere inside the duct as determined on March 21, 2013. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED.
