29 CFR 1910.28(d)(13): Every defect, unsafe condition, or noncompliance with this section was not immediately corrected before further use of the scaffold was allowed: a) At the condenser inside the co-generation plant, the adjustable legs were not locked on the scaffold being used to access the work area exposing employees to a 5 feet 4 inches fall hazard, on or about March 19, 2013. The penalty is reduced to $2,000.00.
