29 CFR 1910.23(e)(1): A standard railing shall consist of top rail, intermediate rail, and posts, and shall have a vertical height of 42 inches nominal from upper surface of top rail to floor, platform, runway, or ramp level. The top rail shall be smooth-surfaced throughout the length of the railing. The intermediate rail shall be approximately halfway between the top rail and the floor, platform, runway, or ramp. The ends of the rails shall not overhang the terminal posts except where such overhang does not constitute a projection hazard. a. At the facility, the porch area, over six feet from the ground, near the docks did not have a standard railing exposing employees to a fall hazard.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation shall not be performed by the customer or user without manufacturers prior written approval. Capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. a. At the workplace, the employer used six foot forklift fork tine extensions to load or unload freight from tractor trailers occasionally. The employer had not obtained written documentation from the manufacturer of the forklift for the modification of the fork lift.
