29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: (a) Construction Site: On or about March 20, 2013, and at times prior thereto, as the controlling employer, Tamarack Construction Company Inc., did not ensure its sub-contractor, Dan Meyer Construction Inc., protected their employees in that employees were exposed to a fall of approximately twenty five feet to the ground below while framing and decking from a flat roof.
