29 CFR 1926.404(b)(1)(i): Employer did not use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section, or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites:    a) On or about 03/21/13, on construction site inside former bank building, 1308 Niagara Falls Blvd., Tonawanda, NY: An employee used a Milwaukee Sawzall to cut back plywood overhead. The saw was connected to 120-volt ac power via an extension cord which was plugged into a wall receptacle in the building. No GFCI or assured equipment grounding program was being used.   NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.452(w)(2): Scaffold casters and wheels were not locked with positive wheel and/or wheel and swivel locks, or equivalent means, to prevent movement of the scaffold while the scaffold was used in a stationary manner:    a) On or about 03/21/13, on construction site inside former bank building, 1308 Niagara Falls Blvd., Tonawanda, NY: Employee was exposed to a potential fall of approx. 4 ft.7 in. while pulling out old wiring, while on the platform of a narrow Renegade mobile metal frame scaffold.  None of the four wheels on the scaffold was locked.   b) On or about 03/21/13, on construction site inside former bank building, 1308 Niagara Falls Blvd., Tonawanda, NY: Employee was exposed to potential fall of approx. 5 ft.11 in. while removing overhead ductwork, while on the platform of a narrow Bil-Jax mobile metal frame scaffold. None of the four wheels on the scaffold was locked.   NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.20(b)(3): Machinery, tool(s), material(s), or equipment which was not in compliance with the applicable requirement(s) of 29 CFR 1926 was not prohibited, and/or was not either identified as unsafe by tagging, or locking the controls to render them inoperable, or physically removed from its place of operation:   a) On or about 03/21/13, on construction site inside former bank building, 1308 Niagara Falls Blvd., Tonawanda, NY:  An extension cord which was plugged into a wall receptacle in the building and used to power a Milwaukee Sawzall, lacked a ground prong on its' plug. The cord was neither identified as unsafe by tagging, rendered inoperable, nor was it physically removed from the jobsite.    NO ABATEMENT CERTIFICATION REQUIRED
