29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s). Workers were engaged in commercial construction activities replacing existing skylights and framing parts. Workers utilized a JLG 600 S articulating, extensible boom aerial lift to access and egress the roof area and hoist glass panels. Workers were exposed to potential fall hazards in that an inspection of the jobsite by a competent person was not conducted. An inspection of the jobsite would have identified the lack of proper fall protection systems and the modified JLG's 600 S basket did not conform to ANSI A92-1969 requirements.

29 CFR 1926.453(a)(2): Field modification of the aerial lift was not certified in writing by the manufacturer or by any other equivalent entity, such as a nationally recognized testing laboratory, to be in conformity with all applicable provisions of ANS. Aerial lifts may be "field modified" for uses other than those intended by the manufacturer provided the manufacturer has certified in writing by the manufacturer or by any other equivalent entity, such as a nationally recognized testing laboratory, to be in conformity with all applicable provisions of ANSI A92.2-1969 and this section and to be at least as safe as the equipment was before modification. Workers were engaged in commercial construction activities replacing existing skylights and framing parts. Workers utilized a JLG 600 S articulating, extensible, boom aerial lift, with wooden 2 inch x 4 inch brackets fastened to the basket, to hoist 6.0 x6.0 foot glass panels to the upper roof area. Workers were exposed to potential fall hazards in that the wooden brackets did not conform to ANSI A92-1969 requirements.
