29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:     The employer does not ensure employees working in areas where there is a possibility of head injury from impact are protected by use of protective helmets. This violation was observed on or about March 21, 2013 on the east side of a newly built townhouse where an employee was exposed to a struck-by hazard when operating a pneumatic nail gun while on a pump jack scaffold installing siding and cornice without wearing a hard hat.        Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees working in areas where there is a possibility of head injury from impact are protected by use of protective helmets.

29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents.  The employer does not ensure employees wear eye protection when machines or operations present potential eye injury. This violation was observed on or about March 21, 2013 on the east side of a newly built townhouse where an employee was exposed to a struck-by hazard when operating a pneumatic nail gun while on a pump jack scaffold installing siding and cornice without wearing safety glasses.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that protective eye equipment is used when machines or operations present potential eye injury.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.     The employer does not protect employees from falling when working on a scaffold 10 feet above lower levels. This violation was observed on or about March 21, 2013, on the East side of a newly built townhouse where an employee was exposed to an approximately 12 foot fall hazard when installing cornice from Alum-A-Pole pump jack scaffold without a fall protection or guardrail system.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each employee ona scaffold more than 10 feet above lower levels are protected from falls by the use of a fall protection or guardrail system.

29 CFR 1926.452(j)(2): Poles were not secured to the structure by rigid triangular bracing or equivalent at the bottom, top, and other points as necessary.    The employer does not secure the poles to the structure at the bottom by triangular bracing or equivalent means. This violation was observed on or about March 21, 2013, on the East side of a newly built townhouse where an employee was exposed to an approximately 12 foot fall hazard when installing cornice from Alum-A-Pole pump jack scaffold without the three supporting poles being secure to the structure at the bottom. The poles were secured at the top only.     Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that poles are secured to thte structure by rigid triangular bracing or equivalent means at the bottom, top, or other points as necessary.
