29 CFR 1926.502(d)(16)(iii): Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level: The employer does not ensure personal fall arrest systems are rigged so that the employee could not free fall 6 feet nor contact a lower level. This violation was observed on or about March 21, 2013, on the north side of a newly built commercial building where an employee was exposed to an 8 foot fall hazard while sitting on a metal beam with a 6 foot lanyard attached to his d-ring. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that personal fall arrest systems are rigged such that an employee could not free fall more than 6 feet nor contact a lower level.

This violation was observed on or about March 21, 2013, on the south side of the building where employees were using a Bosch Worm Drive Saw without a ground pin being installed on the electrical cord. The employer did not remove the equipment from service. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that electrical equipment is free from recognized hazards that are likely to cause death or serious physical harm to employees.

This violation was observed on or about March 12, 2013, on the south side of the building where employees were using a Bosch Worm Drive Saw without a ground pin being installed on the electrical cord. The cord was plugged into a GFCI outlet. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that paths to ground from circuits, equipment, or enclosures are permanent and continuous.
