OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential hazards created by the operation of a Class IV laser.    On or about March 21, 2013 and times prior thereto, the employer had in operation at its facility in Paragould, Arkansas an Amada Lasmac LC 2415 alpha III for cutting material.  The laser is labeled as a Class IV laser product and the facility did not have a designated Laser Safety Officer.  Direct or diffuse contact with a class IV laser beam exposes employees to serious skin burns and irreversible eye injuries.

29 CFR 1910.133(a)(1): The employer did not ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:     On or about March 21, 2013 and times prior thereto, employees operating the Amada Lasmac were not provided eye protection selected specifically for the hazards created by a class IV laser beam.  Employee eye exposure to the direct or reflective beam would result in permanent eye damage.

29 CFR 1910.212(a)(3)(ii): The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle.   On or about March 13, 2013 and times thereto, the All Steel Hydraulic Press Brake serial #6804 was being operated with inadequate point of operation devices.  The light curtain was out adjustment allowing the operator to be exposed to the caught in amputation hazards created by the point of operation.
