One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    (a) Graton Rancheria Construction Site: As the controlling employer, Tutor Perini Building Corp. did not ensure its sub-contractor, Standard Drywall Inc., provided its employees with machine guarding. On February 26, 2013, sub-contracting employees were exposed to the hazard of becoming struck by flying chips and pieces from the cutting wheel of an unguarded Makita chopsaw used to cut metal.

29 CFR 1926.651(h)(1): Employees were working in excavations in which there was accumulated water, or excavations in which water was accumulating, and adequate precautions had not been taken to protect employees against the hazards posed by water accumulation:    Graton Rancheria Construction Site: As the controlling employer, Tutor Perini Building Corp. did not ensure its sub-contractor, Lawson Mechanical Contractors, removed its employees from an approximate 8 foot deep excavation with accumulated water on the east wall. On February 26, 2013, a sub-contracting employee was exposed to cave-in hazards while working within an inadequately protected excavation without an adequate means of protection from water accumulation and subsequent cave-in.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety:    Graton Rancheria Construction Site: As the controlling employer, Tutor Perini Building Corp. did not ensure its sub-contractor, Lawson Mechanical Contractors, removed or prevented its employees from working within an approximate 8 foot deep inadequately protected excavation. On February 26, 2013, a sub-contracting employee was exposed to cave-in hazards while working within an excavation that had been inspected, was accumulating water, and was not configured appropriately for type B soil.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c):     Graton Rancheria Construction Site: As the controlling employer, Tutor Perini Building Corp. did not ensure its sub-contractor, Lawson Mechanical Contractors, provided its employees with an adequate excavation protective system. On February 26, 2013, a sub-contracting employee was exposed to cave-in hazards while working within an approximate 8 foot deep excavation which consisted of an approximate 4 foot vertically sided lower portion. The soil classification was type B and a support or shielding system was not provided.

29 CFR 1926.1053(a)(8): A metal spreader or locking device was not provided on each stepladder to hold the front and back sections in an open position when the ladder was being used:    Graton Rancheria Construction Site: As the controlling employer, Tutor Perini Building Corp. did not ensure its sub-contractor, Standard Drywall Inc., was using step ladders properly. On February 26, 2013, sub-contracting employees worked overhead while using the top step of a 3 foot high metal step ladder that did not have the interior spreader locking devices fully engaged, making the ladder uneven, unstable, and susceptible to giving out.

On February 26, 2013, and at times prior thereto, sub-contracting employees worked overhead while using the top step of 3 foot high metal step ladders and were subsequently exposed to falling, stepping off, or tipping the ladder over.
