29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  This violation occurred March 22, 2013, when employees were allowed to enter and work  into an unprotected trench that was approximately 14 feet in depth, with no cave-in protection in place.

29 CFR 1926.100(a): Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, were not protected by protective helmets.  This violation occurred on March 22, 2013, and again on March 25, 2013, where employees worked at the base of two (2) trenches without protective helmets.

29 CFR 1926.652(a)(1): Each employee in a trench or excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraphs (b) or (c) of this section.   This violation occurred on March 22, 2013, and on March 25, 2013.  Employees worked inside of two (2) trenches exposed to cave-in hazards.

29 CFR 1926.651(j)(2): Employees were not protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection was not provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.  This violation occurred on March 25, 2013, at the job site located at the corners of Bryan and Stonewall, Commerce, Texas.  An employee working at the base of a trench that was approximately 5' 2" in depth was exposed to being struck by excavated materials while laying pipe.  Soil was not placed at least 2' from the edge.
