Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards associated with vehicular traffic:     (a) Acme Tree Service, Inc. @ E 6th Ave. & Kramerica St., Denver, CO 80012: On and before 3/15/13, employees were exposed to struck-by hazards while standing in the live lane of a one way, two lane, 35 miles per hour, residential, road when trimming and/or clearing tree branches. The employees tasked with directing traffic were not equipped with traffic control devices (e.g. paddles or signs).

Employees are exposed to flying debris, noise, amputation, and struck-by hazards.

29 CFR 1910.133(a)(1): Protective eye equipment was not required where there was a reasonable probability of injury that could be prevented by such equipment:        (a) Acme Tree Service, Inc. @ E 6th Ave. & Kramerica St., Denver, CO 80012: On and before 3/15/13, the employer did not ensure that employees were equipped with eye protection. A sawyer utilized a set of sunglasses that did not comply with ANSI Z87.1-1989 standards set forth by paragraph (b)(1) of this section. This condition exposed the employee to flying debris from tree trimming activities.

29 CFR 1910.133(a)(3): The employer shall ensure that each affected employee who wears prescription lenses while engaged in operations that involve eye hazards wears eye protection that incorporates the prescription in its design, or wears eye protection that can be worn over the prescription lenses without disturbing the proper position of the prescription lenses or the protective lenses.  (a) Acme Tree Service, Inc. @ E 6th Ave. & Kramerica St., Denver, CO 80012: On and before 3/15/13, the employer did not ensure that an employee, who operated the chipper, was equipped with prescription safety glasses. The employee was equipped with standard prescription glasses that did not comply with ANSI Z87.1-1989 standards set forth by paragraph (b)(1) of this section. This condition exposed the employee to flying debris.
