29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift.  Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).    Nogle & Black Roofing, Inc. had three employees exposed to 32 ft. falls, while working from an aerial lift without being connected to the boom or basket by a body belt, on a commercial construction site in Champaign, Illinois.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable:  Nogle & Black Roofing, Inc. had three employees exposed to 32 ft. falls from an aerial lift, and the employees were not connected to the boom or basket by a body belt, on a commercial construction site in Champaign, Illinois.  The employer did not provide scaffold training to the employees.  This training would include the following:      a. Nature of any electrical hazards, fall hazards, and falling object hazards in the work area; b. Correct procedures for dealing with electrical hazards and for erecting, maintaining, and disassembling fall protection systems and falling object systems being used;  c. Proper use of the scaffold, and the proper handling of materials on the scaffold;  d. Maximum intended load and the load carrying capacity of the scaffolds used; and  e. Any other pertinent requirements of this subpart, Subpart L  Scaffolds.

29 CFR 1926.501(b)(10): "Roofing work on Low-slope roofs." Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width (see Appendix A to subpart M of this part), the use of a safety monitoring system alone [i.e. without the warning line system] is permitted.    Nogle & Black Roofing, Inc. had employees exposed to 32 ft. fall hazards without fall protection on a low slope roof, on a commercial construction site in Champaign, Illinois.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  Nogle & Black Roofing, Inc. had employees exposed to 32 ft. fall hazards without fall protection on a low slope roof, on a commercial construction site in Champaign, Illinois. The employer did not provide construction safety training to employees, in order to provide them with the knowledge necessary to recognize the hazards of falling and the safety requirements associated with fall protection, as well as the proper work procedures to follow, in order to minimize and eliminate the fall hazards.
