29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) or other exposure to illness or injury: Building 1202 construction project, Presidio of San Francisco, CA - On or about March 21, 2013, and at times prior thereto, the General Contractor, Plant Construction, did not ensure that the subcontractor, Herzer Landscaping Inc. protected its employee by training him in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to his work environment to control or eliminate any hazard(s) while operating a Caterpillar 304D CR, leased from Cresco Equipment Rentals. The employee was exposed to death or serious physical harm from the hazards of being struck by or caught between other surfaces and the rollover of mechanized equipment.

29 CFR 1926.28(a): Appropriate personal protective equipment was not worn by employee(s) in all operations where there was exposure to hazardous conditions: Building 1202 construction project, Presidio of San Francisco, CA - On or about March 21, 2013, and at times prior thereto, the General Contractor, Plant Construction, did not ensure that the subcontractor, Herzer Landscaping Inc. protected its employee from death or serious physical harm from the hazard of being struck by or caught between other surfaces associated with the rollover of mechanized equipment without the use of the operator restraint system. An employee of the subcontractor operating a Caterpillar 304D CR, leased from Cresco Equipment Rentals, was identified not wearing their seatbelt on the date of the inspection.
