29 CFR 1926.200(g)(1): Construction areas were not posted with legible traffic signs at points of hazards: a) This violation was most recently observed on or about February 12, 2013, at or about 413 Prospect Ave., where the employer permitted employees to work without channelizing road users from their normal path to a new path, thereby exposing employees in the work zone to struck-by hazards, as required by Part VI of the MUTCD 1988 Edition, Section 6F-5(a). b) This violation was most recently observed on or about February 12, 2013, at or about 413 Prospect Ave., where the employer did not provide at least one advanced warning sign to when road users that road work is taking place, thereby exposing employees in the work zone to struck-by hazards, as required by Part VI of the MUTCD 1988 Edition, Section 6G-2(b)(4). No abatement certification or documentation is required for this item.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or 1926.652(c): a) Employees working in a trench up to approximately 6.5 feet in depth were exposed to cave-in hazards. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
