29 CFR 1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary.   (a) 4852 Merriman Walk:  Employees were exposed to lower level fall hazards of approximately 20 feet, and struck-bay hazards, while engaged in masonry work from a fabricated frame scaffold that had its planks spaced greater than 1 inch between planks and uprights

29 CFR 1926.451(h)(2)(ii): A toeboard was not erected along the edge of platforms more than 10 feet (3.1 m) above lower levels for a distance sufficient to protect employees below:Note:  This requirement does not apply to float (ship) scaffolds where an edging of 3/4 inch x 1 1/2 inch (2 x 4 cm) wood or equivalent was used in lieu of toeboards.   (a) 4852 Merriman Walk: Employees were exposed to overhead stuck-by hazards while performing masonry work from a fabricated frame scaffold that did not have toeboards installed along all areas of the platform to prevent materials from falling to the lower area.

29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.   (a) 4852 Merriman Walk:  An employee staging bricks on a fabricated framed scaffold was exposed to a lower level fall hazard of approximately 20 feet because no guardrails were installed, nor was personal fall arrest equipment in use.
