29 CFR 1910.95(d)(1): When information indicated that any employee's exposure equaled or exceed the 8-hour time-weighted average of 85 decibels, the employer did not develop and implement a monitoring program: (a) Fabrication Area: A Window Fabricator was exposed to occupational noise at 85.3 % of the permissible daily noise exposure (eight hour time weighted average of 90 dBA at the 90 dB criterion level) during the 441 minute sampling period on 04/03/2013. For a full eight hour shift this would be equivalent to an average sound level of 88.8 dBA. The employer provides hearing protection but did not develop and implement a monitoring program, as determined on 04/03/2013. ABATEMENT CERTIFICATION REQUIRED
