29 CFR 1926.451(g)(1)(vi): Each employee performing overhand bricklaying operations from a supported scaffold shall be protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200 pound toprail capacity). WORKSITE: The employees performing bricklaying operations from the fabricated frame scaffold 10'-10" above the ground were not provided with guardrails or equivalent fall protection system.

29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access. WORKSITE: The employees engaged in bricklaying operations from the fabricated frame scaffold were not provided with appropriate and safe means of access.
