29 CFR 1926.403(b)(2): Listed, labeled, or certified equipment was not installed and used in accordance with instructions included in the listing, labeling, or certification: a) On or about 3/26/13 inside building under renovation at 2680 Delaware Ave., Buffalo, NY: A metal 4-receptacle, 120 volt-ac outlet box attached to a flexible metalic conduit was laying on the concrete floor in the building. A short yellow 3-way extension cord, a battery charger, and a red extension cord were plugged into receptacles on the box. The use of the unmounted box laying on the floor is prohibited by the National Electric Code. NO ABATEMENT CERTIFICATION REQUIRED

Two battery chargers were plugged into receptacles on the 3-way extension cord. The plug on the 3-way extension cord lacked a grounding prong. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.404(b)(1)(ii): On a construction site, where an assured equipment grounding program was not utilized, all 120-volt, single-phase, 15 and 20 ampere receptacle outlets which were not a part of the permanent wiring of the building or structure and which are in use by employees did not have approved ground fault circuit interrupers for personal protection: a) On or about 3/26/13 inside building under renovation at 2680 Delaware Ave., Buffalo, NY: A short yellow 3-way extension cord, a DeWalt portable combination radio/battery charging station, and a red extension cord belonging to another contractor on site were plugged into receptacles on a 4-receptacle, 120 volt-ac outlet box. Two additional battery chargers were plugged into receptacles on the 3-way extension cord. No GFCI was being used. NO ABATEMENT CERTIFICATION REQUIRED
