29 CFR 1910.1030(c)(1)(i): The employer having employee(s) with occupational exposure did not establish a written Exposure Control Plan designed to eliminate or minimize employee exposure:    The employer does not protect employees from illness or disease caused by exposure to blood or other potentially infectious materials during the course of his or her work. This violation was observed on or about March 25, 2013; where the employer did not establish a written Exposure Contol Plan to eliminate or minimize employee exposure to blood or other potentially infectious materials.    Pursuant to 29 C.F.R. 1903.19, within ten(10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to develop and implement a written Exposure Control Plan designed to elimnate or minimize employee exposure to pathogenic blood or other potentially infectious materials.

29 CFR 1910.1030(f)(2)(i): Hepatitis B vaccination was not made available within 10 working days of initial assignment to all employee(s) with occupational exposure:    The employer does not protect employees from illness or disease caused by exposure to blood or other potentially infectious materials found in the workplace. This violation was observed on or about March 25, 2013, in the clinic where the Hepatitis B vaccination was not offered to employees who were exposed to blood or other potentially infectious materials within 10 working days of initial assignment.    Pursuant to 29 C.F.R. 1903.19, within ten(10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all employees are provided the Hepatitis B vaccination within 10 working days of initial assigment to an area having occupational exposure.

29 CFR 1910.1030(h)(2)(i)(D): Employee training records for bloodborne pathogens did not include the names or job titles of all persons attending the training sessions:  The employer does not protect employees from illness or disease caused by exposure to blood or other potentially infectious materials found in the workplace. This violation was observed on or about March 25, 2013, in the clinic where the employer did not document the names or job titles of employees who have received bloodborne pathogen training.  Pursuant to 29 C.F.R. 1903.19, within ten(10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure bloodborne training is properly documented for each employee having occupational exposure to blood or other potentially infectious materials.
