29 CFR 1926.25(a): During the course of construction, alteration, or repairs, form or scrap lumber with protruding nails was not kept clear from work areas.     The employer does not provide a work area clear of protruding nails and form scrap lumber.  This violation was observed on or about March 26, 2013, inside Aeration Basin #1, where employees were accessing and working with scrap form lumber with protruding nails laying on work area floor.       Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that during the course of construction, formwork and scrap lumber with protruding nails are kept clear where employees are working.

29 CFR 1926.501(b)(5): Each employee on the face of formwork or reinforcing steel was not protected from falling 6 feet (1.8 m) or more to lower levels by personal fall arrest systems, safety net systems, or positioning device systems:       The employer did not ensure employees that fall protection is used when working at heights on formwork concrete systems 6 feet or more above lower levels.  This violation was occurred on or about March 26, 2013 where an employee were exposed to an approximate 18 foot fall hazard when installing a corner frame on an Aeration Basin #1 without using fall protection.       Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that fall protection is used when working at heights 6 feet or more lower levels.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    The employer does not provide employees with a program entailing fall protection training program to each employee exposed to fall hazards.  This violation observed on or about March 26, 2013, on the southeast corner of a form wall where employees were exposed to a 20 foot fall hazards when performing climbing and work on top and around form walls without fall protection training.   Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that a fall protection training program is conducted with each employee exposed to fall hazards is established that consists of hazard recognition of falling and procedures to be followed to ensure that before any employee performs climbing or work and could potentially be exposed to a fall hazard causing injury, the employee is trained to know how, where, and where not to tie off with their equipment safely along with requirements of 1926.503(2)(i-viii).

29 CFR 1926.1053(b)(5)(i): Non-self-supporting ladders were not used at an angle such than the horizontal distance from the top support to the foot of the ladder way approximately one-quarter of the working length of the ladder (the distance along the ladder between the foot and the top support).     The employer does not ensure that ladders were not used with a pitch greater than 90 degrees (horizontal). This violation was observed on or about March 26, 2013, southside (outside) of Aeration Basin #1, where employees used the ladder to access the walkway located 16 feet above ground on the east side of Basin #1 with an angle greater than 4:1.      Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that ladders used to access elevated areas are set up with an angle of 4:1 (every 4 feet in height, the ladders should be 1 foot out from the surface) .
