29 CFR 1926.404(b)(1)(ii): On a construction site, where an assured equipment grounding program was not utilized, all 120-volt, single-phase, 15 and 20 ampere receptacle outlets which were not a part of the permanent wiring of the building or structure and which are in use by employees did not have approved ground fault circuit interrupers for personal protection: a) On or about 3/26/13 inside building under renovation at 2680 Delaware Ave., Buffalo, NY: A metal 4-receptacle, 120 volt-ac outlet box attached to a flexible metal conduit was laying on the concrete floor in the building. A red extension cord which was connected to the charging unit on an Admar Skyjack scissors lift was plugged into one of the receptacles on the box. No GFCI was being used. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.404(f)(6): The path to ground from circuits, equipment, or enclosures was not permanent and continuous: a) On or about 3/26/13 inside building under renovation at 2680 elaware Ave., Buffalo, NY: A metal 4-receptacle, 120 volt-ac outlet box attached to a flexible metal conduit was laying on the oncrete floor in the building. A red extension cord which was onnected to the charging unit on an Admar Skyjack scissors lift as plugged into one of the receptacles on the box. The plug on the red extension cord lacked a grounding prong. NO ABATEMENT CERTIFICATION REQUIRED

A red extension cord which was connected to the charging unit on an Admar Skyjack scissors lift was plugged into one of the receptacles on the box. The use of an unmounted box laying on the floor is prohibited by the National Electric Code. NO ABATEMENT CERTIFICATION REQUIRED
