29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system. a) 135 Lincoln Ave., Avon, NJ: Three employees conducting roofing work on the steep sloped (12 on 12 pitch) roof of a three story residential structure were not using fall protection properly and were exposed to a fall hazard greater than 25 feet from the roof to the ground below. Observed on or about 3/26/2013. NOTE: BECAUSE ABATEMENT OF THIS VIOLATION IS ALREADY DOCUMENTED IN THE CASE FILE, THE EMPLOYER NEED NOT SUBMIT CERTIFICATION OR DOCUMENTATION OF ABATEMENT OF THIS VIOLATION AS NORMALLY REQUIRED BY 29 CFR 1903.19.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee who was exposed to fall hazards that enabled each employee to recognize the hazards of falling and train each employee in the procedures to be followed in order to minimize these hazards. a) 135 Lincoln Ave., Avon, NJ: Three employees conducting work on the steep sloped (12 on 12 pitch) roof of a three story residential structure were not using fall protection properly and were exposed to a fall hazard greater than 25 feet from the roof to the ground below. The employer did not train each employee who was exposed to fall hazards to recognize the hazards of falling how to minimize these hazards. Observed on or about 3/26/2013. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
