29 CFR 1903.19(c)(1): The employer did not certify to OSHA, within 10 calendar days after the abatement date, that the cited violation had been abated:  On or about 6/25/13, the employer failed to submit abatement documentation for the following citations issued on 5/30/13.  a) Citation 1, Item 2: 29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii)  Location 43 Newbury Street, Peabody, MA  On or about 3/22/13, the employer did not fully plank the two fabricated scaffold systems prior to the workers accessing the platforms exposing the workers to fall hazards of up to 10-feet, 8-inches.  b) Citation 1, Item 3: 29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, structure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.  Location: 43 Newbury Street, Peabody, MA  On or about 3/22/13, workers were exposed to fall hazards while accessing two fabricated scaffold systems;   1. Rolling yellow fabricated scaffold system - a worker was exposed to fall hazards of greater than 10-feet, 8-inches to access the scaffold platform by use of an unopened portable step ladder and then climbing the outer frame of the scaffold. 2. Black fabricated scaffold system - a worker was exposed to fall hazards of greater than 9-feet, 7-inches to access the scaffold platform by climbing the outer frame of the scaffold.  c) Citation 1, Item 4a: 29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet above a lower level were not protected from falling to that lower level.  Location: 43 Newbury Street, Peabody, MA  On or about 3/22/13, the employer did not provide fall protection to a worker working on the fabricated scaffold system and exposed them to fall hazards of up to 10-feet, 8-inches.  d) Citation 1, Item 4b: 29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  Location: 43 Newbury Street, Peabody, MA  On or about 3/22/13, workers walking, working, and performing new construction on the second floor of the two-story commercial building did not utilize a fall protection system and were exposed to falls of up to 6 feet, 6-inches.
