29 CFR 1926.1101(e)(1): All Class I, II, and III asbestos work was not conducted within regulated areas:   At the Bricker Building, located at 314-318 Broadway Street in Hannibal Missouri where Class I and II asbestos removal work was done, the employer did not conduct the abatement work in regulated areas.  On or about 03/14/2013, the employer removed 1500 Linear feet of pipe wrap, 4000 square feet floor tiles and 4 square feet of transite board out in the open.

29 CFR 1926.1101(f)(1)(i): Where exposure monitoring was required under 29 CFR 1926.1101, the employer did not perform monitoring to determine accurately the airborne concentrations of asbestos to which employees were or potentially were exposed:    At the Bricker Building located at 314-318 in Hannibal, Missouri, where Class I and II asbestos work was conducted, the employer did not perform exposure monitoring prior to the start of the abatement work. On or about 03/14/2013, the employer removed 1500 Linear feet of pipe wrap, 4000 square feet floor tiles and 4 square feet of transite board without the required monitoring.

29 CFR 1926.1101(g)(1)(iii): The employer did not use work practices in all operations covered by 29 CFR 1926.1101, regardless of the levels of exposure, in the form of prompt clean-up and disposal of wastes and debris contaminated with asbestos, in leak-tight containers:    At the Bricker Building located at 314-318 Broadway Street, Hannibal Missouri, where Class I and II work was conducted:   a) The employer did not perform prompt clean up of the asbestos debris. A bulk sample collected after the abatement work, revealed that the debris contained 20% Chrysotile asbestos.    b) Some of the asbetos containing materials such as pipes disposed off in the dumpster at the site were not sealed in leak-tight containers.

29 CFR 1926.1101(k)(8)(i): Labels shall be affixed to all products containing asbestos and to all containers containing such products, including waste containers. Where feasible, installed asbestos products shall contain a visible label.   At the Bricker Building, located at 314 -318 Broadway Street, Hannibal Missouri, where the employer conducted asbestos removal work, the asbestos containing plastic bags were not labeled . On or about 03/15/2013, the employer removed 1500 Linear feet of pipe wrap, 4000 square feet of floor tiles and 4 square feet of Transite board and disposed the acm containing bags without the required warning sign.

29 CFR 1926.1101(h)(1)(iv): Respirators were not used during all Class II and III asbestos jobs where the employer had not produced a negative-exposure assessment:   At the Bricker Building, located at 314-318 Broadway Street, Hannibal Missouri, where the employer conducted asbestos removal work, in which a negative-assessment was not produced, respirators were not used to protect the employee.  On or about 03/14/2013, the employer removed 1500 Linear feet of pipe wrap, 4000 square feet and 4 square feet of transite board without the use of respirators.
