29 CFR 1926.451(c)(3): Supported scaffold poles, legs, posts, frames, and uprights shall be plumb and braced to prevent swaying and displacement.  On or about 03/27/2013, the employer did not ensure that all the scaffold frames on the west and northwest side of the structure were plumb. Numerous scaffold frames at the west  and northwest ends of the structure were out of plumb by as much as 3-4 inches. This could cause the displacement and collapse of the scaffold should the scaffold be struck or moved while employee's are working from the scaffold.

29 CFR 1926.451(e)(1): When scaffold platforms are more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access.  On or about 03/27/2013, the employer did not ensure that ladder access was provided for scaffolding erected near the entartnce to the hotel on th north side of the structure. Scaffolding in this area was approx 42 ft tall and did not have ladder access to the uppper work levels, requiring employees to climb the frame of the tubular welded frame scaffold, which was not designed to be used in such a manner.

29 CFR 1926.451(e)(2)(iii): When hook-on and attachable ladders are used on a supported scaffold more than 35 feet (10.7 m) high, they shall have rest platforms at 35-foot (10.7 m) maximum vertical intervals.  On or about 03/27/2013, the employer did not ensure that a rest platform was installed on th access ladder to the upper work levels of the scaffolding. The employer had attached a hook-on ladder on the scaffolding on the west side of the structure that was approx. 66 ft high without a rest platform at approx. the 35 ft elevation. Employees climbing the ladder could become fatigued while climbing, and withour a rest platform could have fallen to the cement below
