29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used.  Crossbraces were used as a means of access.  a)  At the jobsite, approximately 18 feet from ground, on or about 11/29/12:  Employees were accessing a ladder jack scaffold pick, mounted to the outside of the ladders, and requiring the worker to climb over that pick.    Abatement certification must be submitted for this item.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder rail  length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a)  At the jobsite, approximately 20 feet from ground, on or about 11/29/12:  Employees were accessing a 4:12 pitch roof to perform roofing work where the ladders did not extend 3 feet above the roof eave. 29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)  At the jobsite, on the roof, on or about 11/29/12: Employees were working on a 6:12 pitch roof, approximately 20 feet from ground without fall protection of any kind.    Abatement certification must be submitted for this item.    John Green, dba Honest and Reliable Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard CFR 1926.501(b)(9)(i), which was contained in OSHA inspection number 329844, citation number 1, item number 1 and was affirmed as a final order on 10/9/12, with respect to a workplace located at The Comfort Inn and Suites, 865 SR 37, Hogansburg, NY  13655.
