29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502.    (a)  On or about 3/28/13, on the front of the residence, employees were on the roof installing roofing shingles and were not protected from falling by using any type of fall protection.  The employees were exposed to fall hazards of more than 6 feet to the ground below.    Aguinaldo Dimas was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 728881, Citation Number 1, Item Number 1 and was affirmed as a final order on 3/14/13, with respect to a workplace located at 3915 Plum Vista Place, Arlington, Texas 76005.    Aguinaldo Dimas was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 314278284, Citation Number 1, Item Number 1 and was affirmed as a final order on 5/16/11, with respect to a workplace located at 125 Canadian, Irving, Texas 75039.

29 CFR 1926.1053(b)(1):  Where portable ladders were used for access to an upper landing surface and the ladder���s length allows, the ladder side rails did not extend at least 3 feet (0.9 m) above the upper landing surface being accessed.    (a) On or about 3/28/13, on the front of the house, the Equalizer 24-foot aluminum extension ladder did not have side rails extended at least 3 feet above the upper landing surface that was being accessed by the employees.  The employees were exposed to fall hazards of approximately 8 feet to the ground below.    Aguinaldo Dimas was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(1), which was contained in OSHA inspection number 314184250 Citation Number 1, Item Number 4 and was affirmed as a final order on 10/17/11 with respect to a workplace located at 125 Canadian, Irving, Texas 75039.
