29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section: a) On or about 3/28/13, at the south end of canopy roof over sidewalk on west side of the Dollar Tree store at the Southgate Plaza, 952 Union Rd., West Seneca, NY: A tubular welded frame scaffold was erected to provide access to the canopy roof. Employee climbed up the rungs on the outside, west end of the scaffold to the first level, then switched to the inside, climbed up two more levels, stepped onto the third level consisting of four 2x10 wood planks, then walked approx. 7 ft. on the planks to the east end of the scaffold, and continued climbing, stepped onto the fourth level consisting of two 2x10 wood planks installed in the "ladder rung", then stepped up onto the canopy roof. Employee was exposed to a fall of approx. 15 1/2 ft. from the south side & west end on the third level of the scaffold, and a fall of approx. 20 ft. from the south side & west end on the fourth level of the scaffold. No guardrails or other fall protection system was utilized to protect the employee. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.451(b)(1): Each platform on all working levels of scaffolds was not fully planked or decked between the front uprights and the guardrail supports as specified in paragraphs 1926.451(b)(1)(i)-(ii) a) On or about 3/28/13, at the south end of canopy roof over sidewalk on west side of the Dollar Tree store at the Southgate Plaza, 952 Union Rd., West Seneca, NY: A tubular welded frame scaffold was erected to provide access to the canopy roof. BRAWDY CONSTRUCTION, INC. WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 313843344, CITATION NO. 1, ITEM NO. 2, AND WAS AFFIRMED AS A FINAL ORDER ISSUED ON 11/20/2009, WITH RESPECT TO A WORKPLACE LOCATED AT 495 SKINNERSVILLE ROAD, AMHERST, NY 14260. 29 CFR 1926.501(b)(1): Each employee on a walking/working surface having an unprotected side or edge which was six or more feet (1.8m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) On or about 3/28/13, on canopy roof over sidewalk on west side of the Dollar Tree store at the Southgate Plaza, 952 Union Rd., West Seneca, NY: An employee was exposed to a potential fall of approx. 20 ft. while walking back & forth along the 8 ft.5 in. wide canopy from the south end of the canopy where he had erected an access scaffold to window openings that he had cut through the masonry block wall, a distance of approx. 45 feet. No guardrails or other fall protection system was utilized to protect the employee. NO ABATEMENT CERTIFICATION REQUIRED
