29 CFR 1910.106(e)(6)(i): Adequate precautions were not taken to prevent the ignition of flammable vapors from sources such as open flames; lightning; smoking; cutting and welding; hot surfaces; frictional heat; static, electrical, and mechanical sparks; spontaneous ignition, including heat-producing chemical reactions; and radiant heat. The employer does not ensure that adequate precautions are taken to prevent the ignition of flammable vapors. This violation occurred on or about March 15, 2013, and at times prior thereto, at the Rilco Manufacturing facility where employees were exposed to a fire hazard when cleaning the mixing paddle of an electrical hand drill using acetone without eliminating or controlling sources of ignition. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that adequate precautions are taken to prevent the ignition of flammable vapors.

29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace. The employer does not ensure that employees that are required to wear respirators are medically evaluated to prevent employee injury. This violation was identified on or about March 27, 2013, and at times prior thereto, when employees in the Poly room were exposed to respiration hazards while wearing 3M N95 tight fitting respirators without having been medically evaluated. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all employees that are required to wear respirators are medically evaluated before being fit tested or wearing them in the workplace.
