29 CFR 1926.652(a)(1)(ii):  Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section except when:     Excavations are less than 5 feet (1.52 m) in depth and examination of the ground by a competent person provides no indication of a potential cave-in.   a.  At the excavation site located at the intersection of Hill and Diley Road in Pickerington, Ohio, employees were working in an unprotected trench in order to remove a 15 inch storm drain and to install an 18 inch sewer drain.  The unprotected trench that the employees were working in was at a max depth of 5 feet, 9-1/2 inches, thereby exposing the employees to the hazards associated with a trench cave-in.
