29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: On or about March 29, 2013, on building 3, an employee was applying masonry stone to the building from a scaffold without fall protection. The employee was exposed to a fall hazard of approximately 12 feet to the ground below. The Jose Espinoza dba Jose Espinoza Masonry was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(1), which was contained in OSHA inspection number 311954085, citation number 1, item number 6 and was affirmed as a final order on July 15, 2010, with respect to a workplace located at 4880 Boat Club Road, Lake Worth, TX 76135.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about March 29, 2013, the employer did not ensure fall protection was provided for employees installing masonry stone from a balcony with unprotected sides and edges. The employees were exposed to a fall of 9 feet to the ground below. The Jose Espinoza dba Jose Espinoza Masonry was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number 311949085, citation number 1, item number 1 and was affirmed as a final order on June 2, 2009, with respect to a workplace located at 311 Baily Ranch Road, Aledo, TX 76008.
