29 CFR 1910.266(h)(1)(vi): Each danger tree was not felled, removed or avoided: (a) Castle Rock Inn Area: On or about March 28, 2013, and at times prior, the sawyer was exposed to struck by hazards while felling five trees within approximately twenty-five feet to thirty-five feet of a standing dead Douglas Fir tree (danger tree) that exhibited signs of rot, insect and bird damage and water intrusion due to a missing and broken top section. The danger tree was approximately thirty-three feet in height. The sawyer conducted felling activities within two tree lengths of the danger tree.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: (a) Castle Rock Inn Area: On or about March 28, 2013, and at times prior, the sawyer utilized improper felling procedures in that the horizontal cut (bottom cut) of the conventional face-cut was consistently three to four inches beyond the apex of the angle cut (top cut). (b) Greek Creek Campground Area: On or about March 28, 2013, and at times prior, the sawyer utilized improper felling procedures in that the horizontal cut (bottom cut) of the conventional face-cut was consistently three to four inches beyond the apex of the angle cut (top cut). (c) Moose Creek Campground Area: On or about March 28, 2013, and at times prior, the sawyer utilized improper felling procedures in that the horizontal cut (bottom cut) of the conventional face-cut was consistently three to four inches beyond the apex of the angle cut (top cut). (d) Red Cliff Campground Area: On or about March 28, 2013, and at times prior, the sawyer utilized improper felling procedures in that the horizontal cut (bottom cut) of the conventional face-cut was consistently three to four inches beyond the apex of the angle cut (top cut).

(c) Moose Creek Campground Area: On or about March 28, 2013, and at times prior, the sawyer was exposed to struck by hazard while utilizing improper felling procedures in that the back cut was not above the level of the face cut to fell approximately twenty-five trees at this location.
