29 CFR 1910.106(e)(2)(ii)(b)(2): The quantity of Category 2, 3 or 4 flammable liquid located outside of an inside storage room or storage cabinet in a building or in any one fire area of a building exceeded 120 gallons:    a) Warehouse - An amount in excess of 160 gallons of Category 2, 3 and 4 flammable liquids was stored in the warehouse, exposing employees to a potential fire hazard.  Observed on or about 3/19/13.      NOTE:  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use:    a) Warehouse - Employees handled containers of corrosive materials, including 24 - 1 gallon containers of H & C Infusion Reactive Concrete Stain, 1 gallon of Peel Away Neutralizer, and the employer did not provide an eye wash/safety shower or drench hose for emergency use, exposing employees to injuries.  Observed on or about 3/19/13.      Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.176(b): Storage of material created a hazard:    a) Warehouse -  Containers of paints and other hazardous materials including a 1 gallon can of Sherwin Williams Macropoxy HS part B which is a Category 3 flammable liquid and H & C Infusion Reactive Concrete Stain which is corrosive, were placed on the edge of shelves with the container extending over the edge of the shelf, exposing employees to injuries.     Observed on or about 3/19/13.      b) Warehouse - Pallets with paints and other materials including flammable liquids were placed on shelves with the ends of the pallet extending up to 1 foot over the edge of the shelves exposing employees to injuries.  Observed on or about 3/19/13.      c) Warehouse - Cans of paints and other hazardous materials including flammable liquids were stacked sideways or leaning on top of other containers on the storage shelf, exposing employees to injuries.   Observed on or about 3/19/13.      d) Warehouse - Cans, drums and boxes of paints and other materials including flammable liquids were stored at heights up to 12 ft. and were not stacked symmetrically on top of other containers, exposing employees to injuries.   Observed on or about 3/19/13.      e) Warehouse - Cans of paint were removed from boxes which had other cans and boxes of paint stored on top of them, exposing employees to injuries.    Observed on or about 3/19/13.      f) Warehouse - Cans, drums and boxes of paint and other materials were stacked on shelves and pallets which were deformed, exposing employees to injuries.  Observed on or about 3/19/13.         g) Warehouse - Cans, drums, and boxes of paints and other materials, including flammable liquids were not secured with bands, cross-ties or shrink plastic wrap, exposing employees to injuries.  Observed on or about 3/19/13.      h) Warehouse - Sheets of plywood, pallets or other material were not placed between each tier of 5 and 55 gallon drums of paints and other materials to make a firm, flat, stacking surface, when they were stacked on the floor and on shelves at heights up to 12 feet, exposing employees to injuries.  Observed on or about 3/19/13.     i) Warehouse - Cans, drums, boxes and pallets with cans, drums and boxes of paints and other materials, including flammable liquids were stored on pieces of particle board which did not extend the full length of the shelving unit,   exposing employees to injuries.  Observed on or about 3/19/13.      NOTE:  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    a) Warehouse -  Employees transported, stored, opened and mixed containers of paints, stains, epoxies, lacquers, sealers and cleaners, including containers of flammable and corrosive liquids, and the employer did not develop and implement a written hazard communication program, exposing employees to injuries and illness.  Observed on or about 3/19/13.      Note:  A written program shall include descriptions of how the criteria for the following will be met:    1.  Labeling and other forms of warning;  2.  Material Safety Data Sheets,  3.  Employee information and training.      Additionally, a list of hazardous chemicals known to be present in the workplace must be compiled.  Methods used to inform employees of the hazards associated with non-routine tasks, and the informing of contractors of workplace hazards must also be addressed.  The written program must be made available upon request.      NOTE:  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
