29 CFR 1910.23(c)(1): Open-sided floor(s) or platform(s) 4 feet (1.22 m) or more above the adjacent floor or ground level were not guarded by standard railings (or the equivalent as specified in 29 CFR 1910.23(e)(3)(i) through (v)), on all open sides:    a)     On or about March 29, 2013, the employer, Belvedere Holdings, Inc. d/b/a C&C Sand and Stone Company, did not ensure employees, who were required to gain access to open-sided floors approximately 15 feet above the ground level for item retrieval purposes in the Hibbits Building, were adequately protected from exposure to fall hazards.        b)     On or about March 29, 2013, the employer, Belvedere Holdings, Inc. d/b/a C&C Sand and Stone Company, did not ensure employees, who were required to gain access to an open-sided platform approximately 9 feet above the ground level for item retrieval purposes in the Cement Shed, were adequately protected from exposure to fall hazards.

29 CFR 1910.219(d)(1): Guarding. Pulleys, any parts of which are seven (7) feet or less from the floor or working platform, shall be guarded in accordance with the standards specified in paragraphs (m) and (o) of this section:       a)     On or about March 29th 2013, the employer, Belvedere Holdings, Inc. d/b/a C&C Sand and Stone Company, did not ensure employees were protected from injuries due to exposure to unguarded pulleys, which were part of an air compressor system permanently mounted on a company service truck.

29 CFR 1910.1200(f)(5)(ii): The employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the appropriate hazard warnings:   a)     On or about March 29th 2013, the employer, Belvedere Holdings Inc. d/b/a C&C Sand and Stone Company, did not ensure that all containers with hazardous chemicals were appropriately marked with hazard warning labels.            Note:  An unlabeled container with brake fluid of approximately 1 gallon capacity was observed in the flammable storage cabinet outside the service garage.  In addition, a container labeled as Folger's Coffee, which contained anti-freeze, was observed in the flammable cabinet outside the service garage.
