29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met (Construction Reference: 1926.59):   On or about March 27, 2013, at 481 Northolt Parkway, Suwanee, Georgia:   Fifteen employees performing stucco work using BASF Finestone Pebbletex Mojave SW-6150 Stucco which contains chemicals which include but is not limited to silica were exposed to eye, skin, and lung irritation when the employer did not develop a written hazard communication program to inform employees how to recognize and minimize chemical hazards.

29 CFR 1926.451(c)(1)(ii): Guys, ties, and/or braces were not installed  according to the scaffold manufacturer's recommendations or at the closest horizontal member to the 4:1 height and repeated vertically at locations of horizontal members every 20 feet (56.1 m) or less thereafter for scaffolds 3 feet ((0.91 m) wide or less, and every 26 feet (7.9 m) or less thereafter for scaffolds greater than 3 feet (0.91m) wide:   On or about March 27, 2013, at 481 Northolt Parkway, Suwanee, Georgia:   Fifteen employees performing stucco work were exposed to a fall hazard of up to approximately 53-feet and greater when the tubular welded frame scaffold they worked from was lashed together and tied to the building in places with metal wire and 2 x 4's.

29 CFR 1926.451(f)(14): Makeshift devices, such as but not limited to boxes and barrels, were used on top of scaffold platforms to increase the working level height of employees:   On or about March 27, 2013, at 481 Northolt Parkway, Suwanee, Georgia:   a) Two employees performing stucco work from the fifth buck work platform of a tubular welded frame scaffold were exposed to a fall hazard of approximately 53-feet and greater when they stood on Styrofoam insulation to gain extra height.   b) An employee performing stucco work from the fifth buck work platform of a tubular welded frame scaffold was exposed to a fall hazard of approximately 53-feet and greater when he stood on a five gallon bucket to gain extra height.   c) An employee performing stucco work from the third buck of a tubular welded frame scaffold was exposed to a fall hazard of approximately 21-feet when he stood on a saw horse to gain extra height.

29 CFR 1926.451(g)(4)(i): Guardrail systems were not installed along all open sides and ends of platforms before being released for use by employees other than erection/dismantling crews:  On or about March 27, 2013, at 481 Northolt Parkway, Suwanee, Georgia:  a) Two employees were exposed to a fall hazard of approximately 53-feet and greater when they worked at the edge of the work platform of a tubular welded frame scaffold that did not have an end rail installed on March 27, 2013.   b) Three employees were exposed to a fall hazard of approximately 53-feet and greater when they worked at the edge of the work platform of a tubular welded frame scaffold that did not have an end rail installed on March 29, 2013.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.   On or about March 27, 2013, at 481 Northolt Parkway, Suwanee, Georgia:   a) An employee performing stucco work was exposed to a fall hazard of approximately 53-feet and greater when he sat on the edge of the roof while working without using fall protection.    b) An employee performing stucco work was exposed to a fall hazard of approximately 10.8-feet when he worked while standing on the ledge of the building in between the building and tubular welded frame scaffold without using fall protection.
