Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by a 1950 lb load of conduit pipes: a) Employees were exposed to struck-by hazards while using a cart to transport conduit which was loaded beyond its rated capacity. Location: WTC Transit Hub, Level B-1, New York , N.Y. On or about 3/27/2013 NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.250(d)(2): Portable dockboards shall be secured in position either by being anchored or equipped with devices which will prevent their slipping: a) Employer supplied metal plate where employees were rolling pipe carts loaded with 1961 lb of pipes; the ramp had a metal plate (diamond plate) that was unsecured and can catch the wheels of the pipe carts causing the cart to tip over. Location: WTC Transit Hub, Level B-1, New York , N.Y. On or about 3/27/2013 NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.
