29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about April 2, 2013, during construction activities including, construction of a senior living complex, the employees were working on the unprotected edge of the second floor walking/working surface approximately 11 feet above the ground. The employer did not ensure employees were protected from a fall hazards of approximately 11 feet by ensuring a fall protection system/device was being used.
