29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraphs (b) or (c) of this section:    (a)New Design Construction, Inc. @ 1250 Welton Street, Denver, CO 80204: On and before April 1st, 2013, the exposing employer did not ensure that each employee conducting work in the excavation was protected from cave-in, in that the excavation was approximately 7 feet deep on the north side and lacked a cave-in protective system, such as appropriate sloping, benching, or shielding systems. This condition exposed employees installing 4x4's on an existing sewer line to a crushing hazard by excavation wall cave-in.

29 CFR 1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:    (a) New Design Construction, Inc. @ 1250 Welton Street, Denver, CO 80204:  On and before April 1st, 2013, the exposing employer did not ensure a competent person inspected the excavation prior to start of work and during each shift in that the competent person did not identify the lack of an appropriate protective system and did not take prompt corrective action to eliminate the cave-in hazard.  This condition exposed the employee to the hazards of working near the sides of an unprotected excavation approximately 7 feet in depth on the north wall.     Abatement Note:  "Competent person" means one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them
