OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards. (a) The employer did not ensure that all components of a chain and pin below-the-hook lifting device was had the proper identification including; manufacture's name and address, serial number, and rated load.

29 CFR 1926.251(a)(1): Rigging equipment for material handling shall be inspected prior to use on each shift and as necessary during its use to ensure that it is safe. Defective rigging equipment shall be removed from service. (a) Employees were exposed to crushing hazards while setting a manhole cover and the employer did not ensure that the rigging equipment was inspected in between lifts to ensure that it was safe and secure before re-lifting.
