29 CFR 1926.405(a)(2)(ii)(I): Flexible cords and cables shall be protected from damage. Sharp corners and projections shall be avoided. Flexible cords and cables may pass through doorways or other pinch points, if protection is provided to avoid damage.    a. On or about April 01, 2013, the extension cord being used to energize the rotary hammer was damaged, thereby exposing employees to contact with electrical current hazard.    b. On or about April 01, 2013, the extension cord being used to energize the rotary hammer and that had been damaged was pinched in a door way, thereby exposing employees to contact with electrical current hazard.

29 CFR 1926.451(c)(1)(ii): Guys, ties, and braces shall be installed according to the scaffold manufacturer's recommendations or at the closest horizontal member to the 4:1 height and be repeated vertically at locations of horizontal members every 20 feet (6.1 m) or less thereafter for scaffolds 3 feet (0.91 m) wide or less, and every 26 feet (7.9 m) or less thereafter for scaffolds greater than 3 feet (0.91 m) wide. The top guy, tie or brace of completed scaffolds shall be placed no further than the 4:1 height from the top. Such guys, ties and braces shall be installed at each end of the scaffold and at horizontal intervals not to exceed 30 feet (9.1 m) (measured from one end [not both] towards the other).    a. On or about April 01, 2013, employees were observed working on a scaffold 5 bucks high, roughtly 40 feet in the air. The scaffold was braced to the building with rope tied around a vertical support member and secured to the building with a nail.

29 CFR 1926.451(f)(7): Scaffolds shall be erected, moved, dismantled, or altered only under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Such activities shall be performed only by experienced and trained employees selected for such work by the competent person.    a. On or about April 01, 2013, employees were working from a scaffold that had been erected without the supervision of a competent person.

29 CFR 1926.451(g)(1)(vii): For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee shall be protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.     a. On or about April 02, 2013, employees were observed working outside the protection of the guardrail system without fall protection, approximately 40 feet from the ground, thereby exposing the employee to a fall hazard.

29 CFR 1926.451(g)(3): In addition to meeting the requirements of 1926.502(d), personal fall arrest systems used on scaffolds shall be attached by lanyard to a vertical lifeline, horizontal lifeline, or scaffold structural member. Vertical lifelines shall not be used when overhead components, such as overhead protection or additional platform levels, are part of a single-point or two-point adjustable suspension scaffold.    a. On or about April 02, 2013, an employee working outside the protection of the guardrails from a fabricated frame scaffold was not properly secured by a lanyard to a vertical life line, horizontal lifeline or structural member.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards. The training shall include the following areas, as applicable:    a. On or about April 01, 2013, the employer had not provided employee with training on the hazards associated with the use of scaffolds prior to the erection and utilization, thereby exposing the employees to a fall hazard.
