29 CFR 1926.600(a)(3)(i): Bulldozer and scraper blades, end-loader buckets, dump bodies, or similar equipment were not fully lowered or blocked when being repaired or when not in use: (a) Project # 731 TOKA, San Xavier, AZ 85617: On or about 4 April 2013, and at times prior thereto, a TEREX handler belonging to the employer was observed parked and not in use and unattended in the main project roadway and adjacent to a new-build single family residential construction area in progress, with the forktines elevated 25 inches off the ground, exposing employees and equipment to hazards.

29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval: (a) Project # 731, TOKA Housing Project, San Xavier, AZ 85617: On or about 4 April 2013, and at times prior thereto, the employer did not ensure that modifications to the forktines were made by drilling a 1 1/4 inch hole in each of the two lifting tines, without obtaining manufacturer approval, exposing employees to hazards.
