29 CFR 1926.652(a)(1):     Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c). The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation was sloped at an angle steeper than one and one half horizontal to one vertical (34 degrees measured from the horizontal):    a) On 4/4/13 an employee was working in a trench without any protection from cave-in. The trench was between 7.5' and 11' deep, approximately 4' to 5' wide with near vertical walls.  The trench was not properly sloped, benched or shored.     Feaker and Sons Co, Inc. was previously cited for a violation of this Occupational Safety and Health standard, which was contained in OSHA Inspection Number 312556020, Citation Number 1, Item Number 2B and was affirmed as a Final Order on 4/20/10, with respect to a workplace located at 128 W. Wisconsin Ave, Neenah, WI 54956.
