29 CFR 1926.251(a)(2)(iii): The employer failed to ensure that rigging without affixed, legible identification markings, required by paragraph (a)(2)(i) of this section was not used.   (a) 50 Horseblock Road, Yaphank, NY (Worksite), Manufacturing Building - Employees hoisting and connecting open web bar joists used 3/8" x 8' wire rope slings, which did not have permanently affixed tags, indicating the recommended safe working load, on or about April 3, 2013.  (b) Worksite, Linkbelt 140 Ton Mobile Crane - Employees hoisting and connecting open web bar joists used a two-legged, 1" x 20' L, wire rope spreader assembly, which did not have permanently affixed tags, indicating the recommended safe working load indicating the recommended safe working load, on or about April 3, 2013.  Note: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.453(b)(2)(iv): Employee(s) working in an aerial lift were sitting or climbing on the edge of the basket:   (a) Worksite, Manufacturing Building, along Column Line L and between Column Lines 10 - 24 (Inclusively) - An employee connecting open web bar joists from a JLG articulating boom aerial lift, Model # 660SJ / Serial # 0300 150512, climbed on the edges of the basket as he moved to and from the aerial lift in an elevated work area, measured to be 46'-6" above the ground, on or about April 3, 2013.  Note: In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:  (a) Worksite, Manufacturing Building, along Column Line L and between Column Lines 10 - 24 (Inclusively) - The employee connecting open web bar joists from a JLG articulating boom aerial lift, Model # 660SJ / Serial # 0300 150512, in an elevated work area measured to be 46'-6" above the ground, was working without fall protection, on or about April 3, 2013.   Note: In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.  Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).
