29 CFR 1926.24: The employer shall be responsible for the development and maintenance of an effective fire protection and prevention program at the job site throughout all phases of the construction, repair, alteration, or demolition work. The employer shall ensure the availability of the fire protection and suppression equipment required by Subpart F of this part. a. At the work site the employer had employees that were involved in the bracing of a concrete block wall while performing hot work activities which caused a fire. The employer did not have an effective program that would require that work be performed in a safe location, or with fire hazards removed or covered, or to use guards to confine the heat, sparks, and slag, and to protect the immovable fire hazards.

29 CFR 1926.352(a): When practical, objects to be welded, cut, or heated shall be moved to a designated safe location or, if the objects to be welded, cut, or heated cannot be readily moved, all movable fire hazards in the vicinity shall be taken to a safe place, or otherwise protected. a. At the work site located at 1125 East Main Street in Newark, Ohio the employer performed welding activities to install lifting lugs on the C-channel steel beam. The welding activities were done inside, approximately 15 feet from a propane tank in storage and approximately 25 feet from bales of un-shielded cotton rags.
