29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employees ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (Construction Reference 1926.103) On or about 4/1/2013, at the Athens job site, employees using tight fitting respirators were not provided a medical evaluation prior to using the respirator. No abatement certification or documentation is required for this item.

29 CFR 1910.134(f): The employee was required to use a respirator without being fit tested with the same make, model, style and size of respirator that was to be used: (Construction Reference 1926.103) On or about 4/1/2013, the employer did not provide fit tests to employees required to use tight fitting 1/2 mask respirators prior to the employees using the respirators. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

The training must be comprehensive, understandable, and recur annually, and more often if necessary. (Construction Reference 1926.103) On or about 4/1/2013, the employer did not provide training in the company's respiratory protection program to employees who were required to wear tight fitting respirators prior to the employees using them. In accordance with 29 CFR 1903.19(c), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
