29 CFR 1926.95(a):  Personal protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, was not provided, used, or maintained in a sanitary and reliable condition it was necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation, or physical contact:  (a) Building Roof - on or about April 5, 2013 - employees that were using Bostich and Hitachi pneumatic nail guns were not wearing any eye protection, such as safety glasses with side shields.

29 CFR 1926.150(c)(1)(vi):  A fire extinguisher, rated not less than 10B, was not provided within 50 feet of wherever more than 5 gallons of flammable or combustible liquids or 5 pounds of flammable gas were being used on the jobsite:  (a) Jobsite - on or about April 5, 2013 - no fire extinguisher was available on site for the flammable liquid (gasoline) storage area.

29 CFR 1926.1053(b)(1):  Where portable ladders were used for access to an upper landing surface and the ladders length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  (a) East side of Building - on or about April 5, 2013 - the ladder that was used as access to the work area on the roof deck did not extend the requisite three feet above the upper surface.  Roof deck elevation was nine feet from the ground.
